Sport Aberdeen is the Data Controller of the personal data you provide to us and is registered with the Information Commissioner’s Office (Ref: Z3565299).

We are committed to protecting your privacy and complying with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003.

1. Introduction

These Terms and Conditions explain how we supply Eskuta e-bikes, accessories, and related products through our website. By placing an order, you agree to these Terms.

3. Ordering and acceptance

  • All orders are subject to availability and acceptance.
  • After you place an order, you will receive an email confirming receipt. This is not acceptance.
  • Your order is accepted when we issue a Dispatch Confirmation or agree a delivery date for your e-bike.
  • We may decline an order if payment cannot be authorised or if a listing error is identified.

4. Prices and payment

  • Prices are in pounds sterling and include VAT.
  • Payment is due in full at checkout unless agreed in writing.
  • Accepted payment methods are shown on the website.
  • Obvious pricing errors may be corrected before dispatch.
  • Business fleet orders will have separate agreed terms.

5. Delivery

  • Eskuta E-bikes include free delivery across mainland Scotland.
  • Our own trained team completes delivery.
  • Target delivery is within 14 days of order confirmation, or on a later date agreed with you.
  • We will contact you if a delay occurs and confirm a delivery slot.
  • Accessories and small items are sent by Royal Mail Tracked Delivery.
  • Spare batteries can only be purchased with a new bike at present due to courier restrictions.

6. Handover and acceptance

  • Your Eskuta e-bike arrives fully assembled, tested, and charged.
  • Our staff will demonstrate controls, battery removal and charging, and help with fit adjustments.
  • Please inspect the bike at delivery and report any issues immediately.
  • Responsibility for the product passes to you once signed for.

7. Risk and ownership

  • Ownership passes to you when payment is received in full.
  • Risk transfers at delivery.
  • Until paid in full, ownership remains with Sport Aberdeen trading as Eskuta Scotland.

8. Returns and cancellations

  • You have 14 days from the day after delivery to cancel for any reason.
  • Returned products must be unused, in original condition, and include all accessories.
  • You are responsible for return costs unless the item is faulty or mis-described.
  • Refunds are processed within 14 days of receiving the return.
  • We may deduct for any loss in value caused by handling beyond what is necessary to check the item.

9. Faulty or damaged goods

  • If an item arrives damaged or develops a fault within a reasonable period, contact us promptly.
  • We will repair, replace, or refund in line with the Consumer Rights Act 2015.
  • Damage caused by misuse, neglect, or unauthorised modification is not covered.
  • Manufacturer warranty terms apply in addition to your statutory rights.

10. Warranty

  • New Eskuta e-bikes include a manufacturer warranty covering key components and electrical parts.
  • Warranty service is coordinated by Eskuta Scotland and approved partners.

11. Liability

  • We are not liable for loss of income, loss of opportunity, or other indirect loss.
  • Our total liability will not exceed the price paid for the product.
  • Nothing limits liability for death or personal injury caused by negligence.

12. Servicing and maintenance

  • Routine servicing is recommended.
  • Use of non-approved parts or modifications may void the warranty.
  • Paid servicing options may be offered through Adventure Aberdeen.

13. Business and fleet orders

  • Additional terms will apply, including payment schedules, insurance, and usage conditions.
  • Fleet agreements must be confirmed in writing and signed by both parties.

14. Data protection

  • Personal data is processed in line with Sport Aberdeen’s Privacy Policy.
  • By ordering, you agree that we may use your details for processing, delivery, and warranty registration.

15. Governing law

These Terms are governed by the laws of Scotland. The Scottish Courts will have jurisdiction.

16. Updates

We may update these Terms. The version active when you place your order will apply.
